1. Acceptance of Terms

These Terms and Conditions of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User") and PawScripts, LLC ("we," "us," or "our"), concerning your access to and use of PawScripts web-based software application (the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.

2. Privacy and HIPAA Compliance

Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference.

No Medical Advice: The Service is a software tool designed for transmitting medication scripts to retail pharmacies. It does not provide medical advice, diagnosis, or treatment.

3. User Accounts and Security

Registration: To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.

Account Security: You are responsible for maintaining the confidentiality of your password and account details. You agree to notify us immediately of any unauthorized use of your account.

Liability: PawScripts will not be liable for any loss or damage arising from your failure to comply with this security obligation.

4. Intellectual Property Rights

Our IP: The Service, including its code, design, layout, graphics, and functionality, is the proprietary property of PawScripts, LLC and is protected by copyright, trademark, and other intellectual property laws.

User Content: You retain full ownership of the data, files, and information ("User Content") you upload to the Service. You grant us a limited, non-exclusive license to access, store, and process your User Content solely for the purpose of providing the Service to you.

5. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:

Systematically retrieving data to create a collection, compilation, database, or directory without written permission.
Reverse engineering, decompiling, or disassembling any aspect of the Service.
Using the Service to transmit viruses, malware, or other harmful code.
Violating any applicable federal, state (including Arizona state laws), or international laws or regulations.

6. Payment and Subscription

Service fees are billed per the contract agreed prior to the entity beginning use of the Service. All payments are non-refundable unless otherwise required by law.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will PawScripts, LLC its affiliates, directors, or employees be liable to you for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, even if we have been advised of the possibility of such damages.

8. Disclaimer of Warranties

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. We disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and defined following the laws of the State of Arizona. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts located in Maricopa, Arizona.

This SMS Transactional Messaging Privacy Policy ("Policy") describes how PawScripts collects, uses, and protects the information associated with your use of our transactional SMS messaging service.

1. What is Transactional Messaging?

Our SMS transactional messaging service is designed to send you essential, non-marketing, and functional messages related to your prescriptions sent for your pet by your veterinarian.

Examples of transactional messages include:

Script confirmations and pharmacy location.
Potential savings coupons for the medication.

2. Information We Collect

When we use the transactional SMS service, we have collected from the veterinary clinic the following information necessary to deliver the service:

Mobile Phone Number: The number you provided or have on file with the veterinary clinic, used as the destination for the messages.
Message Content: The content of the transactional message (e.g., the prescription data and pharmacy location).
Message Metadata: Technical information such as the time the message was sent, delivery status, and any errors encountered.

3. How We Use Your Information

We use the collected information exclusively for the purpose of providing, maintaining, and improving the transactional SMS service, which includes:

Delivering Messages: Sending the requested or necessary transactional messages to your device.
Service Maintenance: Troubleshooting delivery issues and ensuring the service functions reliably.
Compliance: Meeting legal and regulatory requirements.

4. Sharing of Information

We do not sell, rent, or trade your mobile phone number or personal information for marketing purposes.
We may share your information with third-party service providers, such as SMS gateway providers, solely for the purpose of facilitating the transmission of the transactional messages.
We may also disclose your information if required to do so by law, court order, or governmental regulation.

5. Opting Out

Because these messages are transactional and not promotional, they are generally considered necessary for the proper functioning of the service. Therefore, we generally do not encourage a 'STOP' keyword for transactional messages.

'HELP', 'STOP', and 'JOIN' keywords are available for use if preferred.

You should contact your veterinarian to have your number removed from this service.

6. Data Security

We implement appropriate administrative, technical, and physical security measures to protect the personal information we collect from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

1. Introduction

PawScripts, LLC ("we," "us," or "our") operates the PawScripts web-based software application (the "Service"). We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information.

By using our Service, you agree to the collection and use of information in accordance with this policy.

2. Protected Health Information (PHI) and HIPAA Compliance

As a provider of software services that may handle or have similar information as Protected Health Information (PHI), we acknowledge our obligations are similar to that under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HITECH").

HIPAA Data Retention Policy

We maintain strict data retention protocols to ensure the confidentiality, integrity, and availability of PHI.
Retention Period: We retain PHI and associated documentation for a minimum period of two (2) years following the date of record creation or the date the record was last in effect, whichever is later.
Extended Retention: Notwithstanding the above, if applicable federal or state laws (including the HIPAA standard of six years for certain compliance documentation) require a longer retention period, we will retain data for that extended duration.
Disposal: Upon the expiration of the retention period, or upon a valid request for deletion (subject to legal retention requirements), all PHI will be securely destroyed or rendered unreadable in accordance with NIST 800-88 standards for media sanitization.

3. California Consumer Privacy Act (CCPA) Rights

If you or the veterinarian client is a resident of California, the CCPA provides you with specific rights regarding your Personal Information.

Right to Know/Access: You/They have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.

Right to Delete: You/They have the right to request that we delete any of your personal information that we collected from you/them and retained, subject to certain exceptions.

Right to Opt-Out of Sale or Sharing: We do not sell your/their personal information. You/They have the right to opt-out of the sharing of your personal information for cross-context behavioral advertising.

Right to Correct: You/They have the right to request that we correct any inaccurate personal information we maintain about you/them.

Right to Limit Use of Sensitive Personal Information: You/They have the right to limit the use and disclosure of your/their sensitive personal information to that which is necessary to perform the services.

Right of Non-Discrimination: We will not discriminate against you for exercising any of your/their CCPA rights.

4. Security Breach Notification (Arizona Law)

We have established the following procedures in the event of a security system breach that materially compromises the confidentiality, integrity, or availability of unencrypted or unredacted personal information of residents of any US state.

Determination and Notification Timeline

Upon discovery of a security breach, we will conduct a reasonable and prompt investigation. If we determine that a breach has occurred and is likely to result in misuse of the personal information, we will notify affected individuals without unreasonable delay.
In no case shall notification occur later than the timeframe mandated by the most restrictive state law applicable to the affected residents.

To use the web application, we collect from the veterinary clinic the following information necessary to deliver the service:

We use the collected information exclusively for the purpose of providing, maintaining, and sending a prescription at the request of the veterinarian for veterinary use in an animal.

7. Sharing of Information

We do not sell, rent, or trade your/their mobile phone number or personal information for marketing purposes.
We may share your information with third-party service providers, such as SMS gateway providers, solely for the purpose of facilitating the transmission of the transactional messages.
We may also disclose your information if required to do so by law, court order, or governmental regulation.

1. Pawscripts, LLC will send you an SMS message notifying you when your veterinarian has submitted a prescription to a retail pharmacy for your pet. It will include the pharmacy name and information, your pet's name, and the medication name.

2. You can cancel the SMS service at any time. Just text "STOP". After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. You will no longer receive SMS messages from us. If you want to rejoin again, type Join.

3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at sales@getpawscripts.com.

4. Carriers are not liable for delayed or undelivered messages.

5. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive 1 message per prescription submitted. If you have any questions about your text plan or data plan, you should contact your wireless provider.
